1. Acceptance of Terms

By accessing or using ekada.app (the "Service"), operated by Ekada ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Ekada is a comprehensive business management and customer engagement platform. Our Service includes tools for retail management, e-commerce storefronts, digital billing, and loyalty programs. We provide the software infrastructure for you to manage your business; we do not act as a party to the transactions between you and your customers.

3. User Accounts

To access the Service, you must register a business account. You are responsible for maintaining the accuracy of your business information and for all activity occurring under your account credentials.

4. Data Ownership

You retain all rights to the business data and customer lists you upload to the platform. You grant Ekada a limited license to host and process this data solely to provide the Service to you.

5. Payment and Billing

Our subscription billing is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for all Ekada subscriptions. They handle payment processing and tax collection.

  • Ekada Subscription Refunds: You may request a refund within 14 days of your initial Ekada subscription purchase via Paddle support.
  • Cancellations: You may cancel your subscription at any time via your billing dashboard.
  • Merchant Customer Transactions: Ekada is a software platform and is not the seller or fulfillment party for your end-customer purchases. Refunds, returns, and fulfillment obligations for those transactions are handled by the merchant using Ekada.

6. Acceptable Use

You agree not to use the Service for fraudulent activities, unauthorized messaging (spam), or to distribute content that infringes on the rights of others.

7. Intellectual Property

The Ekada platform, its design, and its proprietary code are the exclusive property of Ekada. You may not copy or reverse-engineer any part of the Service.

8. Limitation of Liability

The Service is provided "as is." Ekada shall not be liable for any loss of profits or business interruptions. Our total liability is limited to the amount paid for the Service in the 12 months preceding any claim.

9. Termination: We reserve the right to suspend access if you violate these Terms. Upon termination, your public-facing storefronts and business dashboard will be disabled.
